Terms of Service

Welcome to Quizify. Quizify, at quizify.fun, is a product of Learnify ("Learnify", "we", "us", or "our"). It provides quiz games that teachers play with their class on a shared screen, and the tools to make, import and keep the quizzes (the "Services").

Quizify uses the same account as Learnify at learnify.fun: an account made on either site works on both. By using the Services you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Services. We may update these Terms from time to time. When a change matters to you, we will tell you on the site or by email before it takes effect, and continuing to use the Services after that means you accept it.

1. Privacy

Your use of the Services is also governed by our Privacy Policy, which is Learnify's policy and covers Quizify in full.

2. Who can use Quizify

The Services are for teachers, parents and educational administrators who are 18 years of age or older. Students do not have accounts: they play on the class screen that the teacher runs. If you use Quizify on behalf of a school or organization, you confirm that you may agree to these Terms for it.

3. Your account

You are responsible for keeping your sign-in details private and for everything done under your account. Give accurate information and keep it up to date, and tell us at once at support@learnify.fun if someone uses your account without your permission. We may suspend or close accounts that break these Terms.

4. Students and class data

You can play Quizify without entering any student information: teams can be named any way you like. If you play with a Learnify class, the students in that class and the points they get are governed by the Learnify Terms of Service, including your responsibilities for consent and for student privacy laws.

5. Acceptable use

You agree not to:

• Break any applicable law or regulation
• Use the Services to harm, harass, bully or exploit others
• Access accounts or data without permission
• Interfere with or disrupt the Services, servers or networks
• Reverse engineer, decompile or try to extract source code from the Services
• Upload malicious code, viruses or any harmful content
• Scrape, crawl or use automated tools to extract data from the Services without permission
• Impersonate another person or entity
• Use AI features to make inappropriate, harmful or misleading content

We may investigate and act against anyone who breaks these Terms, including removing content, suspending accounts and reporting to law enforcement.

6. Your quizzes

• You keep ownership of the quizzes, questions and pictures you make or import ("User Content")
• You give Learnify a non-exclusive, worldwide license to host, store, show and distribute your User Content within the Services, only to provide them
• If you make a quiz public, other teachers can find it and play it with their classes
• You are responsible for making sure your User Content does not infringe anyone else's rights, and for importing only quizzes you are allowed to use
• Your User Content must be suitable for school: nothing inappropriate, offensive or harmful
• We may remove User Content that breaks these Terms without notice

7. AI-generated quizzes

• AI writes a first draft to help you; review every question before you play it with students
• We do not guarantee that AI-generated content is accurate, complete or appropriate
• Do not use AI-generated content for high-stakes assessments or grading without human review
• AI features have a monthly allowance that depends on your plan

8. Our content

The Services and everything in them that is not User Content, including the games, artwork, text, logos, sounds and software, belong to Learnify and are protected by intellectual property laws. You get a limited, non-exclusive, non-transferable license to use them for their educational purpose. You may not copy, modify, distribute, sell or create derivative works from them without our written permission.

9. Plans and payments

Quizify Free costs nothing. Quizify Plus is a paid subscription, billed monthly or yearly. All payments are processed by Paddle, our merchant of record, which handles billing, taxes and receipts. By subscribing, you agree to the following:

• You pay the price shown for the plan and billing period you chose
• Quizify Plus has no free trial: the first payment is taken when you subscribe
• The subscription renews automatically at the end of each billing period, monthly or yearly, unless you cancel before the renewal date
• You can cancel at any time in your account or by contacting us. If you cancel a period you have already paid for, you keep Quizify Plus until that period ends
• Every paid Learnify plan includes Quizify Plus for as long as that plan is active. If you also pay for Quizify Plus on its own, you can cancel it; we do not cancel a subscription for you
• New prices apply to new subscriptions. A subscription you already have keeps its price for as long as it continues on the same plan and billing period. If we ever need to change the price of your subscription, we will email you at least 30 days before the renewal it applies to, and you can cancel before then
• Prices depend on the country you live in. Do not use a VPN, a proxy or a false address to buy at a price meant for another country; if you do, we may cancel that subscription. This does not limit your right under EU law to buy on the same terms as customers in another EU country
• Refunds are provided under our Refund Policy

10. Ending your use

You can stop using the Services and ask us to delete your account at any time at support@learnify.fun. We may suspend or end your access for breaking these Terms. When access ends, your right to use the Services stops, we may delete your account data under our Privacy Policy, and the sections that by their nature should continue (including intellectual property, limitation of liability and indemnification) stay in effect.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES. IN NO EVENT SHALL LEARNIFY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO LEARNIFY IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

13. Indemnification

You agree to indemnify, defend and hold harmless Learnify, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your breach of these Terms, your breach of any law, or your User Content.

14. Force majeure

Learnify is not liable for any failure or delay in meeting its obligations under these Terms caused by circumstances beyond its reasonable control, including natural disasters, acts of government, internet outages, power failures, cyberattacks and pandemics.

15. Governing law and disputes

These Terms are governed by applicable laws, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Services will first be resolved through good faith negotiation. If negotiation fails, it will be resolved through binding arbitration under applicable arbitration rules, on an individual basis and not as a class action.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable or invalid, it will be enforced to the maximum extent permissible and the rest of these Terms stays in effect. These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between you and Learnify about Quizify.
